<p>Before a car, motorcycle, or truck accident insurance policy can be canceled in Georgia, the insurance company must jump through the six hoops established by O.C.G.A. 33-24-44 and O.C.G.A. 33-24-45.</p>
<p>The cancellation must be in writing; explicit; delivered by hand or sent by first class mail to the person’s last known address; give the reason for the cancellation per O.C.G.A. 33-24-45; and provide notice of eligibility for insurance through a state-sponsored plan, pursuant to O.C.G.A. 33-24-45, unless cancellation is for failure to pay premiums.</p>
<p>If a cancellation notice is received, check to be sure the insurance company has jumped through each of the six hoops.</p>
<p>One way insurance companies get out of paying claims is to deny there was coverage for the accident. This is a common tactic used by claims adjusters to deny claims they should pay to people hurt or injured in car, motorcycle, or truck accidents.</p>
<p>What if the insurance company tells me the at-fault driver’s insurance policy has cancelled?  Don’t give up!</p>
<p>If you’ve been hurt or injured in an auto, motorcycle, or truck accident caused by the fault or negligence of another driver, and that driver’s insurance company says his insurance was cancelled before the accident, call an attorney. <p>Georgia law requires a minimum amount of insurance coverage for your insurance policy if you are to drive your car, motorcycle, or truck on the roads and streets of the state. Do you know the magic numbers? You should to be sure the car insurance you bought is legally effective. The answers are found at O.C.G.A. 33-34-3.</p>
<p>In the Georgia insurance law, your minimum automobile coverage must be $25,000 for liability for bodily injury or death to one person in any one accident; $50,000 for bodily injury or death to two or more persons in any one accident; and $25,000 for damage to or destruction of property. And, there are additional requirements.  For example, the policy must cover at a minimum a six month period.</p>

<p><span style="font-family: Times New Roman; font-size: small;"> </span>Some personal injury attorneys speak to their clients in “legalese”; you know what we mean: the special words and phrases used in the practice of law by some attorneys to impress their clients. At <a title="Atlanta Car Accident Attorneys" href="http://www.millarandmixon.com" target="_blank"><span style="text-decoration: underline;">Millar &amp; Mixon</span>, LLC</a>, we don’t do that to our clients. We are a car, truck and motorcycle injury law firm in Atlanta, Georgia, dedicated to helping all of our clients — not just with words, but with results.You might be surprised to learn that insurance agents also use their own form of “leagalese” when selling your policy.  For example, agents love to tell people that the policy includes “full coverage.” What is that?  There is no legal definition of “full coverage.”   Anything the insurance agent tells you about your policy is not included in your coverage unless it is in writing in the insurance policy. This is because Georgia law requires that everything covered by the insurance be written in the policy itself.  The Georgia Court of Appeals discussed this issue in a case called <span style="text-decoration: underline;">Wilder v. Jefferson Ins. Co. of New York</span>.</p>
<p>So, while many automobile insurance agents tell their policy holders that they have “full coverage,” many of our clients who have not read the policy are in for a nasty shock! (You may not be covered if the at-fault driver is un-insured or underinsured).  What is not actually covered may be vastly be different from what the insurance sales person told you.  So remember, the next time you hear someone talk about the “four corners” of your insurance policy, he simply means the document itself, regardless of the number of pages it has or what the insurance company has told you it says. Knowing what is—-and is not&#8211;in your car insurance policy is the key to knowing what is actually covered.</p>

<p>You know the law requires you to have insurance whenever you drive a car, truck or motorcycle in Georgia. But what happens if you want to drive before you have received your new or renewed insurance policy from the insurance company – will you be protected in case you are hurt in an accident?</p>
<p>Generally, the insurance company will give you a document that is called a “binder.” The binder serves two important purposes. One: it provides a summary of your insurance coverage and, two, it can serve as proof of insurance until you receive your policy in the mail. But as we attorneys here at <span style="text-decoration: underline;">Millar &amp; Mixon</span>, LLC, know, there are some special things to keep in mind regarding your insurance binder.</p>
<p>First, according to the Georgia statute found at O.C.G.A. 33-24-33, the insurance coverage provided by the “binder” is only good for 90 days, starting with the day it became effective. So, you must be sure your insurance policy is issued before the 90 days expires. Otherwise, you could be driving without insurance. Of course, as soon as the insurance policy is issued within the 90 day period, your binder is no longer necessary.</p>
<p>Second, under some circumstances a “binder” can be created simply by the conversation you had with the insurance agent, and it should include the typical terms of the insurance policy you have purchased, but not yet received. However, the status of your oral “binder” is not always crystal clear. So, don’t get caught in a bind about your “binder.”</p>

<p><span style="font-size: small;"><span style="font-family: Times New Roman;">Drunk driving is a teen problem, especially this time of year.  As the end of the school year approaches, many teenagers are gearing up for prom season.  This can be an exciting time in any teenager’s life as the end of the year festivities are common and the summer season has begun to be celebrated. </span></span></p>
<p><span style="font-size: small;"><span style="font-family: Times New Roman;">Unfortunately, many high school students will begin to experiment with alcohol during this time.  It’s important to make sure that students are educated so that they avoid drunk driving accidents.  Take the time to discuss the following information with your teenager.  The drunk driving accident and injury attorneys at Millar &amp; Mixon hope all Georgia high school students stay safe this prom season.</span></span></p>

<li><span style="font-size: small;">·</span> <span style="font-size: small;"><span style="font-family: Times New Roman;">Ask your teenager what he or she would do in such a situation.  Make it clear that it’s best to call you or a loved one for a ride home.  Emphasize that there will be no negative consequences if your child calls for a ride.</span></span></li>
