Policy Limits Settlement for Victim of Drunk Driver (2010)
Our clients’ father was killed by a drunk driver who was over-served alcohol in a bar and grill near Atlanta. After being served multiple drinks while he was visibly and noticeably intoxicated, the drunk driver crossed the center line and struck our clients’ father head-on, killing him. A lawsuit was filed against the bar that served the alcohol and against the intoxicated driver. The cases were settled for the insurance policy limits after it was discovered that the tavern destroyed a video surveillance recording that would have shown how many drinks the driver had been served in a short period of time.
Recovery for Passenger in a Car Accident (2011)
A female client in her late 20s suffered a severely broken leg that required surgery in a Butts County, Georgia, crash. The accident was caused when an oncoming driver, traveling too fast for conditions, hydroplaned and struck the car in which our client was riding. She was hospitalized for three days and had medical bills totaling approximately $50,000.
Driver Hit While Crossing an Intersection (2011)
Our client was driving his 1995 Nissan Altima in Cobb County, Georgia. He entered an intersection with the right of way, pursuant to a green light. The at-fault driver turned left directly in front of our client, causing a violent collision. After being diagnosed with knee and back injuries, including traumatically induced degenerative disc disease, a lawsuit was filed. The case was settled for $350,000.
Jury Verdict for Driver who Rear-Ended a Logging Truck (2011)
Our client received a Jury Verdict for $143,000 after he struck the back end of a logging truck that was driving at night on a dark road without proper safety lighting on the load of logs. The driver was hospitalized for three days and sustained a broken nose that required reconstructive surgery. The verdict was reduced by 15% to approximately $122,000 for contributory negligence.
Settlement for Passenger in Car that Struck a Backhoe (2010)
We represented a child who was a passenger in her baby-sitter’s car. After cresting a hill, the baby-sitter crashed into a backhoe that was driving slowly on the road in the same direction. Fault was contested. After we hired an accident reconstruction expert to prove the difficulty the driver would have faced in observing and reacting to the backhoe in time to avoid the crash, the case settled after mediation.
Recovery for Bicyclist Struck by Car (2010)
The client was riding his bicycle in a crosswalk near Alpharetta, Georgia, when he was struck by an inattentive driver who was looking left while turning right. He suffered a mild concussion, broken jaw and a short stay in the hospital. The case was successfully resolved for the limits of one insurance policy and part of another.
Against a Drunk Driver for Aggravation of Back Injury (2011)
Our client was struck by a drunk driver who crossed the center line. Although he had a long history of low back pain and a previous disc herniation, we were able to prove that the accident with the DUI driver had worsened his condition. The case was resolved without a lawsuit being filed after an evaluation by, and report from, an orthopedic surgeon.
Policy Limits for Pedestrian Caught in a Chain Reaction Crash (2010)
We were able to recover the entire $100,000 policy for an Atlanta client who was struck while walking in a crosswalk. Two cars had crashed in the center of an intersection, causing one of the vehicles to strike our client. She suffered a broken right thumb and lacerations to her lips and forehead.
For Teenage Children Hit by a DUI Driver (2010)
This lawsuit was filed against an Atlanta driver who ran a stop sign and injured two teenage passengers. The case settled on the courthouse steps for the drunk driver’s policy limits after it was discovered that the driver had a previous conviction for DUI.
Policy Limits for a Flight Attendant Hit by a 15-year-old Driver (2011)
Our client, a Henry County, Georgia, flight attendant with a history of back injury, recovered the policy limits of a 15-year-old driver with a learner’s permit. The teenage driver ran a stop sign and T-boned our client, aggravating her previous back injury.
